  9. IMPORTANT-READ CAREFULLY: This End-User License 
  10. Agreement ("EULA") is a legal agreement between you 
  11. (either an individual or a single entity) and The 
  12. LSoft Techologies for the Active@ KillDisk later 
  13. referred to as 'SOFTWARE'. By installing, copying, 
  14. or otherwise using the SOFTWARE you agree to be bound 
  15. by the terms of this EULA. If you do not agree to the 
  16. terms of this EULA, do not install or use the 
  17. SOFTWARE.
  18.  
  19. WE REQUIRE ALL OUR DEALERS TO PROVIDE EACH PURCHASER
  20. WITH FREE DEMO OF THE SOFTWARE TO GET A FULL 
  21. UNDERSTANDING OF THE CAPABILITIES AND THE EASE OF USE
  22. OF THE SOFTWARE. OUR DEALERS HAD TO RECOMMEND YOU TO 
  23. DOWNLOAD DEMO. WE WON'T ISSUE ANY REFUNDS AFTER 
  24. PURCHASING FULL VERSION OF THE SOFTWARE.

  26. LSoft Techologies may have patents, patent 
  27. applications, trademarks, copyrights, or other
  28. intellectual property rights covering subject matter 
  29. in this document. The furnishing of this document 
  30. does not give you any license to these patents, 
  31. trademarks, copyrights, or other intellectual 
  32. property.
  33.  
  34. SOFTWARE LICENSE 
  35.  
  36. 1. The SOFTWARE is licensed, not sold. Copyright laws
  37. and international copyright treaties, as well as other
  38. intellectual property laws and treaties protect the 
  39. SOFTWARE.
  40.  
  41. 2. GRANT OF LICENSE.
  42.  
  43. (a) FREE DEMO COPY.  You may use the full featured 
  44. DEMO SOFTWARE without charge on an evaluation basis 
  45. to erase floppies and hard disk drives using 
  46. [One Pass Zeros] data destruction method only. 
  47. You must pay the license fee and register your copy
  48. to get professional version of the product that can 
  49. erase floppies and HDDs using other data destruction 
  50. methods, including DoD 5220.22-M, and the most secure 
  51. Gutmann's method.
  52.  
  53. (b) REDISTRIBUTION OF DEMO COPY.  If you are using 
  54. DEMO SOFTWARE on an evaluation basis you may make 
  55. copies of the DEMO SOFTWARE as you wish; give exact 
  56. copies of the original DEMO SOFTWARE to anyone; and 
  57. distribute the DEMO SOFTWARE in its unmodified form 
  58. via electronic means (Internet, BBS's, Shareware 
  59. distribution libraries, CD-ROMs, etc.). You may not 
  60. charge any fee for the copy or use of the evaluation
  61. DEMO SOFTWARE itself, but you may charge a 
  62. distribution fee that is reasonably related to any 
  63. cost you incur distributing the DEMO SOFTWARE (e.g. 
  64. packaging). You must not represent in any way that 
  65. you are selling the software itself. Your 
  66. distribution of the DEMO SOFTWARE will not entitle 
  67. you to any compensation from LSoft Techologies. 
  68. You must distribute a copy of this EULA
  69. with any copy of the Software and anyone to whom you
  70. distribute the SOFTWARE is subject to this EULA.

  72. (c) REGISTERED COPY.  After you have purchased the 
  73. license for SOFTWARE, and have received SOFTWARE 
  74. distribution package, you are licensed to copy the 
  75. SOFTWARE only into the number of floppy disks
  76. corresponding to the number of licenses purchased.  
  77. Under no other circumstances may the SOFTWARE be 
  78. operated at the same time on more than the number 
  79. of floppy disks for which you have paid
  80. a separate license fee. You may not duplicate the 
  81. SOFTWARE in whole or in part, except that you may 
  82. make one copy of the SOFTWARE for backup or archival
  83. purposes. You may terminate this license at any time
  84. by destroying the original and all copies of the 
  85. SOFTWARE in whatever form.  You may permanently 
  86. transfer all of your rights under this EULA provided
  87. you transfer all copies of the SOFTWARE (including 
  88. copies of all prior versions if the SOFTWARE is an 
  89. upgrade) and retain none, and the recipient agrees 
  90. to the terms of this EULA.

  92. (d) SITE AND ENTERPRISE LICENSES
  93. "Site" license means that you can use SOFTWARE 
  94. without of any limitations at one company's office 
  95. (one physical location).
  96. "Enterprise" license means that you can use SOFTWARE
  97. without of any limitations at all company's offices 
  98. and branches (worldwide).

  100.  
  101. 3. RESTRICTIONS.  You may not reverse engineer, 
  102. decompile, or disassemble the SOFTWARE, except and 
  103. only to the extent that such activity is expressly
  104. permitted by applicable law notwithstanding this 
  105. limitation. You may not rent, lease, or lend the 
  106. SOFTWARE. You may permanently transfer all of your 
  107. rights under this EULA, provided the recipient 
  108. agrees to the terms of this EULA. You may not use the
  109. SOFTWARE to perform any unauthorized transfer of 
  110. information (e.g. transfer of files in violation of a
  111. copyright) or for any illegal purpose.

  114. 4. SUPPORT SERVICES. LSoft Techologies 
  115. may provide you with support services related to the
  116. SOFTWARE. Use of Support Services is governed by the
  117. LSoft Techologies polices and programs described in 
  118. the online documentation and web site, and/or other 
  119. LSoft Techologies-provided materials, as they may be 
  120. modified from time to time.
  121. Any supplemental software code provided to you as part
  122. of the Support Services shall be considered part of 
  123. the SOFTWARE and subject to the terms and conditions 
  124. of this EULA. With respect to technical information 
  125. you provide to LSoft Techologies as part 
  126. of the Support Services, LSoft Techologies may use such 
  127. information for its business purposes, including for 
  128. product support and development. LSoft Techologies will 
  129. not utilize such technical information in a form that 
  130. personally identifies you.
  131.  
  132. 5. TERMINATION. Without prejudice to any other 
  133. rights, LSoft Techologies may terminate 
  134. this EULA if you fail to comply with the terms and 
  135. conditions of this EULA. In such event, you must 
  136. destroy all copies of the SOFTWARE.

  138.  
  139. 6. COPYRIGHT. The SOFTWARE is protected by copyright
  140. law and international treaty provisions. You 
  141. acknowledge that no title to the intellectual 
  142. property in the SOFTWARE is transferred to you. 
  143. You further acknowledge that title and full ownership
  144. rights to the SOFTWARE will remain the exclusive 
  145. property of LSoft Techologies and you 
  146. will not acquire any rights to the SOFTWARE except as
  147. expressly set forth in this license. You agree that 
  148. any copies of the SOFTWARE will contain the same 
  149. proprietary notices which appear on and in the 
  150. SOFTWARE.

  152. 7. DISCLAIMER OF WARRANTY. LSoft Techologies
  153. expressly disclaims any warranty for the 
  154. SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION
  155. IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, 
  156. EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT 
  157. LIMITATION, THE IMPLIED WARRANTIES OR 
  158. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  159. OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF
  160. USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

  162. 8. LIMITATION OF LIABILITY. IN NO EVENT SHALL LSOFT
  163. TECHNOLOGIES OR ITS SUPPLIERS BE LIABLE TO 
  164. YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR
  165. INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE 
  166. DELIVERY, PERFORMANCE, OR USE OF THE SOFTWARE, EVEN 
  167. IF LSOFT TECHNOLOGIES HAS BEEN ADVISED OF
  168. THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, LSOFT
  169. TECHNOLOGIES'S ENTIRE LIABILITY UNDER ANY 
  170. PROVOSION OF THIS EULA SHALL BE LIMITED EXCLUSIVELY 
  171. TO PRODUCT REPLACEMENT.

  173. LSoft Techologies reserves all rights not
  174. expressly granted here.
